Determination是“决心”吗？

“determination”一词常规情况下有“决心、决定、确定”之义，但总是如此吗？非也！
在香港公司章程（通常由《组织章程大纲》Memorandum of Association和《组织章程细则》Articles of Association组成）中，作为法律文书用语，determination往往表示“地产权、财产利益、权利、权力等的终止”。
例句：The number of members of the company (exclusive of persons who are in the employment of the company and of persons who having been formerly in the employment of the company were while in such employment and have continued after the determination of such employment to be members of the company) is limited to fifty.
公司成员人数不超过五十人（不包括公司雇用的人士，亦不包括先前受公司雇用并且在雇用期间为公司成员以及雇用终止之后仍为公司成员的人士）。
其他一些法律文件常用语也值得关注，例如“provided that”，其用法与“if”或“but”类似，意思相当于“如果”或者“但是”。在该短语之前存在一个主句的情况下，它表示一个与之前陈述相反的例外，应翻译成“但是”。
例句：Provided that where two or more persons hold one or more shares in the company jointly they shall for the purpose of this regulation be treated as a single member.

“without prejudice to”也是一个我们熟悉的短语，相当于“without affecting”，可译为“在不损害……的原则下”、“在不影响……的情况下”。
